Death Penalty to rape- convict of the rape of girls below 12 years of age- a new bill is to be introduced in the present monsoon sessions of Parliament.
Rape is the fourth most common crime against women in India. According to the NationalCrime Records Bureau (NCRB) 2013 annual report, 24,923 rape cases were reported across India in 2012. In 2015, 10,854 cases of rape under Section 376 of the IPC and under Sections 4 and 6 of the Protection of Children against Sexual Offences (POCSO) Act were registered pan-India, 2016 saw 19,765 of such cases were registered. The number of rapes and sexual abuse on children unreported is much higher than the reported throughout the country.
Present law has loopholes which need to be plugged-in as many escapes with minor punishments.
Central government realizing the urgency has produced a bill to that effect that convict in the rape case of a minor gets the death penalty.
The Criminal Law (Amendment) 2018 will replace the present Criminal Law (Amendment) ordinance dated 21-04-2018. The bill also suggests:
- 10 years instead of 7 years to a rape -convict of a woman.
- 20 years instead of 10 years to a rape-convict of a girl aged between 12 to 16 years.
- Imprisonment for rest of the life of each rape convict involved in the rape of a girl aged 12 to 16 years.
POCSO amendment for enhanced punishment in case sexual assaults on young boys has been revised. The amendment bill is ready to be submitted to the cabinet for approval. Soon to come up in the present parliament session for approval.
